Lola + The Boys Terms & Conditions for Marketing Communications

By placing an order on lolaandtheboys.com or at any Lola + The Boys physical location, you agree to the following terms and conditions regarding your subscription to our SMS and email marketing lists:

1. Express Consent:

  • Your act of placing an order and providing your contact information (phone number and/or email address) during checkout constitutes your express written consent to receive marketing communications from Lola + The Boys through SMS messages, MMS messages, and email. This includes, but is not limited to, promotional offers,discounts, event announcements, and product updates.
  • Your consent also applies to any subscriptions obtained through website capture forms, including pop-ups offering discount codes in exchange for contact information. By providing your information on such forms, you explicitly agree to receive marketing communications via your chosen channel(s).

2. Messaging Platforms:

  • Lola + The Boys utilizes Attentive Mobile as our SMS service provider and Klaviyo as our email service provider.We are not responsible for any carrier-related delays or failures in message delivery.
  • You understand that each platform requires separate opt-out mechanisms:
    • SMS: To opt-out of SMS marketing, simply reply STOP to any message you receive from Lola + The Boys.
    • Email: Click the "unsubscribe" link in the footer of any Lola + The Boys email.

3. Frequency and Content:

  • Lola + The Boys reserves the right to determine the frequency and content of its marketing communications. You may receive messages regarding promotions, new products, seasonal offers, special events, and other relevant information.
  • We strive to provide valuable and timely content, but you acknowledge that you may not find all messaging to be of interest.

4. Opt-Out and Revocation of Consent:

  • You have the right to unsubscribe from our marketing communications at any time, through the methods specified above (STOP for SMS, unsubscribe link in email footer).
  • Your opt-out request will be processed within 10 business days. Once you opt-out, you will no longer receive marketing communications from Lola + The Boys via the chosen platform(s).
  • You may also revoke your consent for future data collection and marketing by contacting us at angeli@freedommedia.com.

5. Changes to Terms & Conditions:

  • Lola + The Boys reserves the right to modify these Terms & Conditions at any time. We will notify you of any changes by posting the updated terms on our website and/or sending you an email notification. Your continued use of our services after any changes constitutes your acceptance of the revised Terms & Conditions.

6. Governing Law and Jurisdiction:

  • These Terms & Conditions are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Illinois, and you consent to the personal jurisdiction of such courts.

7. Miscellaneous:

  • These Terms & Conditions constitute the entire agreement between you and Lola + The Boys with respect to your subscription to our marketing communications. No waiver of any provision of these Terms & Conditions shall be effective unless in writing and signed by an authorized representative of Lola + The Boys.
  • If any provision of these Terms & Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
